Customer terms for diagnostic, repair, maintenance, modification, testing, storage, and shipping services.
1. Agreement, parties, and service scope
These Repair Terms and Conditions (the “Terms”) are between The Drone Hospital, LLC (“Company,” “we,” “us,” or “our”) and the customer identified in the applicable intake form, estimate, work order, invoice, or online submission (“Customer” or “you”).
These Terms apply only to diagnostic, inspection, repair, maintenance, modification, testing, storage, and shipping services for drones, controllers, batteries, cameras, payloads, and related equipment (collectively, “Equipment”). Flight operations, training, retail product sales, drone purchases, fleet subscriptions, and loaners require separate terms or a written statement of work. If a signed estimate or work order conflicts with these Terms on a job-specific business term, the signed estimate or work order controls that term; these Terms control otherwise.
2. Customer eligibility, ownership, and authority
You represent that you are at least 18 years old and either own the Equipment or have authority from the owner to request service, approve testing, and bind the owner to these Terms. You will disclose any lien, lease, rental, government ownership, evidence hold, law-enforcement restriction, or other limitation that affects our custody or work. We may request identification or proof of authority and may refuse Equipment or instructions that appear unlawful, unsafe, or unauthorized.
3. Intake, condition, and hidden damage
We may document the Equipment’s apparent condition, serial numbers, accessories, batteries, and packaging at intake. You should review the intake record and identify existing damage, missing items, prior repairs, crashes, water or salt exposure, corrosion, heat exposure, software modifications, or intermittent failures.
Drone damage is often concealed. Disassembly, cleaning, charging, firmware activity, calibration, powered testing, or ordinary handling may reveal or worsen a pre-existing condition. We are not responsible for a failure caused by pre-existing damage, latent defects, normal wear, corrosion, contamination, prior work, manufacturer defects, unsupported software, or information you did not disclose, except to the extent caused by our negligence or other liability that cannot lawfully be limited.
4. Standard diagnosis and paid advanced diagnosis
Our standard diagnosis is free. It may include visual inspection, ordinary bench testing, fault-code review, limited disassembly, and preparation of an estimate. A free diagnosis is not a guarantee that every defect will be found or reproduced.
We will obtain separate written or electronic authorization before performing a specialized, destructive, unusually time-consuming, manufacturer-level, or other advanced diagnostic for a fee. The authorization will disclose the fee or the method for calculating it. Diagnostic labor may be due even if you decline a repair when you separately approved that labor.
5. Estimates, approvals, and changes
We will not begin a paid repair until you approve an estimate or other written scope and price. Unless the estimate states otherwise, it is valid for 30 days and is based on conditions reasonably observable at the time. Taxes, shipping, insurance, expedited service, and optional work may be listed separately.
If we discover a material change in scope, price, parts, or expected timing, we will request additional approval before proceeding. Approval may be given by signed document, checked online box, authenticated portal action, email, or text message that identifies the job. We may pause or close a job if you do not respond after reasonable follow-up.
6. Parts and substitutions
The estimate will identify, when material, whether a part is manufacturer-original/OEM, new aftermarket, refurbished, salvaged, customer-supplied, or functionally equivalent. We will not represent a part as “genuine,” “OEM,” or new unless that description is accurate. Availability, color, cosmetic match, manufacturer pairing, and future firmware compatibility are not guaranteed unless stated in the estimate.
A substitution that materially changes the represented part category, price, or expected performance requires your approval. Manufacturer core, exchange, or return programs may require us to retain a replaced part.
7. Cancellation, special orders, and deposits
You may cancel before approving an estimate without a repair charge, except for separately authorized advanced diagnosis, return shipping, or emergency handling. After approval, you owe for work performed, nonreturnable or special-order parts, shipping, taxes, and documented third-party charges incurred before cancellation. Deposits may be applied to those amounts; any remaining balance will be refunded.
8. Prices, payment, taxes, and chargebacks
Payment is due as stated in the estimate or invoice and, unless agreed otherwise, before release or return shipment. You authorize us to charge an approved deposit and the final approved balance using the selected payment method. You are responsible for applicable sales, use, and similar taxes. A good-faith billing question should be sent to us before initiating a chargeback so we can investigate; this does not waive cardholder rights.
9. Batteries and hazardous materials
Lithium batteries can ignite, vent, or explode. Tell us before delivery if any battery is swollen, punctured, crushed, leaking, unusually hot, recalled, water-damaged, or otherwise suspect. Do not mail or tender a damaged, defective, or recalled battery without our advance written shipping instructions and carrier-compliant packaging. We may refuse, isolate, discharge, move, or arrange lawful disposal of an unsafe battery when reasonably necessary to protect people or property.
You are responsible for disclosed and approved third-party disposal, hazmat, carrier, or emergency-response costs, except to the extent caused by our negligence. We may decline to return or ship a battery when doing so would violate law or carrier rules.
10. Testing, firmware, calibration, and test flights
You authorize tests reasonably necessary to diagnose or verify approved work, including power-up, motor operation without propellers when feasible, charging, calibration, firmware or software activity, short-range communications, payload checks, and controlled ground or flight testing. We will use reasonable safety practices and only conduct a test flight when reasonably needed and operationally appropriate.
When federal rules require it, test flights will be conducted under the supervision of an appropriately certificated remote pilot and applicable FAA requirements. A test may reveal a latent defect or produce ordinary wear. You may request written limits on testing, but those limits may prevent diagnosis, verification, or warranty coverage for an untested function.
11. Software, data, accounts, and media
Back up and remove data you do not want us to access before service. Repair can require resets, firmware changes, storage replacement, log review, or other actions that alter or erase data and settings. We do not guarantee preservation of flight logs, photographs, video, maps, credentials, configurations, or other data. You authorize access only as reasonably necessary to perform or verify the approved service.
Do not send permanent passwords. If access is essential, provide a temporary credential through an approved channel, restrict it to the minimum access necessary, and rotate or disable it promptly after service. Our Privacy Notice describes how service records and personal information are collected, used, retained, and disclosed. We will not use identifiable customer media, testimonials, or before-and-after content for advertising without separate permission.
12. Shipping and delivery
Obtain any required return authorization and follow our packing instructions. Remove propellers and prohibited hazardous materials unless instructed otherwise. You bear the risk of loss or damage during inbound transit until the shipment is delivered to us. For outbound transit, risk passes when we tender the package to the carrier, except for loss or damage caused by our inadequate packing or nonwaivable law.
Carrier liability may be limited. The intake form should state the Equipment’s declared value and whether you request shipment insurance. Shipping dates are estimates, not guarantees, unless expressly stated. We will provide required delay or refund options for merchandise orders when applicable.
13. Replaced parts and environmental handling
Ask for return of replaced parts before repair begins. We may be unable to return parts that are hazardous, contaminated, subject to a core or exchange program, required for a warranty claim, or prohibited from shipment. Unless return is timely requested and legally permitted, you authorize reasonable recycling or disposal.
14. Timing and events outside our control
Turnaround dates are good-faith estimates. Parts shortages, manufacturer systems, weather, carrier delays, airspace restrictions, power or internet outages, safety concerns, and other events outside reasonable control may delay service. We will communicate material delays and will not be liable for delay caused by such an event, but this section does not excuse refund or notice duties imposed by law.
15. Limited 90-day repair warranty
For 90 days after the repaired Equipment is first made available for pickup or delivered to the return carrier, we warrant that paid repair labor will be performed in a workmanlike manner and that Company-supplied parts will materially conform to the description in the approved estimate. A longer manufacturer or written project-specific warranty controls if expressly stated.
The warranty covers only the repaired function and the Company-supplied part identified on the work order. It does not cover an unrelated failure, crash or impact, water or contamination, misuse, improper storage or charging, ordinary wear, consumables, battery degradation, customer-supplied parts, unsupported modifications, malware, manufacturer services or lockouts, later work by another person, or a condition we could not reasonably reproduce or test. Custom or experimental work is covered only to the extent stated in the estimate.
Notify us promptly and provide the Equipment and service record for evaluation. For a valid claim, our exclusive remedy—at our option—is to reperform the covered labor, repair or replace the covered Company-supplied part with a reasonably equivalent part, or refund the amount paid for the covered repair. This limited warranty is in addition to rights that cannot be waived. Except for this express warranty and nonwaivable warranties, we disclaim other warranties to the fullest extent permitted by law.
16. Customer-supplied parts and custom work
We do not warrant customer-supplied parts and may refuse a part that is unsafe, counterfeit, incompatible, or of uncertain origin. You assume the risk of incompatibility or failure inherent in a customer-supplied part or expressly experimental/custom instruction, but not the risk of damage caused by our negligent installation or work. Additional labor caused by defective or incompatible customer-supplied parts requires approval.
17. Pickup, storage, liens, and unclaimed Equipment
We may retain possession of Equipment until lawful charges are paid. If Equipment is not picked up or return shipping is not arranged, we will send any notice required by applicable law before assessing storage charges or enforcing a lien. Storage charges, lien rights, foreclosure, sale, recycling, or disposal will occur only in the amount, manner, and time permitted by law. Nothing in these Terms authorizes self-help that Georgia law does not allow.
18. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOSS OF USE, BUSINESS INTERRUPTION, LOST DATA, OR REPLACEMENT-DRONE RENTAL, EVEN IF ADVISED OF THE POSSIBILITY.
For physical loss of or damage to Equipment while in our custody that is caused by us, our aggregate liability will not exceed the lesser of (a) the Equipment’s documented fair-market value immediately before the event or (b) the declared value recorded at intake. If no declared value is recorded, the maximum is $5,000. For other claims arising from a specific job, aggregate liability will not exceed the greater of the amount paid for that job or $500. These limits do not apply to gross negligence, willful misconduct, fraud, personal injury caused by us, or liability that cannot lawfully be limited.
19. Customer responsibility and limited indemnity
You are responsible for claims arising from your lack of ownership or authority; your illegal instructions; undisclosed hazardous materials; or content, software, data, or parts you supply that infringe another person’s rights or cause harm. You will defend and indemnify us from a third-party claim to that extent, except to the extent the claim results from our negligence, willful misconduct, or breach of these Terms.
20. Disputes and Georgia law
Before filing suit, the parties will try in good faith for at least 30 days to resolve a written dispute notice describing the claim and requested resolution. Either party may use an eligible small-claims process or seek urgent injunctive relief without completing that period. Georgia law governs, without regard to conflict-of-law rules. Subject to nonwaivable consumer rights, exclusive venue lies in the state or federal courts having jurisdiction over the county of our principal place of business in Georgia, and each party consents to personal jurisdiction there.
21. General terms
These Terms, the accepted estimate or work order, the intake authorization, and incorporated policies are the entire agreement for the service. Changes to an active job require a writing accepted by both parties. Website updates apply prospectively and do not change an already accepted job unless both parties agree. If a provision is unenforceable, it will be limited to the minimum extent necessary and the rest will remain effective. A failure to enforce is not a waiver. You may not assign the agreement without our consent; we may assign it with a business transfer if customer rights are not materially reduced. Provisions that by nature should survive completion—including payment, warranty limits, liability limits, disputes, and data obligations—survive.
22. Notices, contact, and acknowledgment
Service notices may be sent to the email, phone number, portal, or shipping address in the work order. Notices to us may be sent through our website or to the contact information below. Keep a copy of the accepted Terms and work order.
